1. Introduction
Welcome to Unfold Brand (“Unfold,” “we,” “our” or “us”).
These Terms & Conditions govern your access to and use of our website and describe the general terms applicable to our website content and services.
By accessing or using this website, you agree to these terms. If you do not agree, please discontinue using the website.
Specific services may also be governed by a separate proposal, quotation, statement of work, service agreement or other written terms. Where applicable, those agreed project terms will govern the specific engagement to the extent of any inconsistency with these general terms.
2. Our Services
Unfold may provide services across the following areas:
- Brand: brand strategy, logo design, visual identity, brand guidelines, packaging and creative applications.
- Digital Presence: website strategy, design and development, landing pages and related digital services.
- Growth: marketing strategy, Meta Ads, lead-generation support, campaign setup and optimisation.
- Business Support: assistance with business registration processes, trademark-related support, licence-related processes and selected business consultancy.
The availability, scope and delivery of individual services depend on the project requirements and our written agreement with the client.
Information on this website is general in nature and does not constitute a binding quotation or commitment to provide a particular service.
3. Enquiries and Proposals
Submitting an enquiry through our website does not automatically create a client relationship or oblige either party to proceed with a project.
Before work begins, we may provide a proposal or quotation describing the agreed scope, deliverables, fees, timeline, payment terms, revision allowance and other applicable conditions.
A project will proceed once the relevant terms have been accepted and any agreed initial payment or onboarding requirements have been completed.
4. Fees and Payments
Fees, payment schedules and any applicable taxes will be communicated in the relevant proposal, quotation, invoice or service agreement.
Unless otherwise agreed in writing:
- Work will begin after the agreed onboarding requirements are completed.
- The client must make payments according to the agreed schedule.
- Additional work outside the agreed scope may incur additional charges.
- Delayed payments may affect project timelines or lead to a pause in work, subject to the applicable agreement and law.
Third-party expenses—including hosting, domain registration, software subscriptions, advertising spend, stock assets, printing, government fees and professional fees—are not included unless expressly stated in writing.
5. Project Scope, Revisions and Client Responsibilities
The deliverables, timeline and included revisions will be defined in the relevant proposal or service agreement.
The client is responsible for:
- Providing accurate and complete information.
- Supplying required content, assets, access and approvals on time.
- Ensuring they have the necessary rights to materials provided to us.
- Reviewing deliverables and providing consolidated feedback within agreed timeframes.
- Ensuring that their products, services, claims and business operations comply with applicable laws.
Delays in receiving information, access, feedback or approvals may affect delivery dates.
Requests beyond the agreed scope may require a revised timeline and additional fees.
6. Intellectual Property
Each party retains ownership of intellectual property it owned before the project.
Ownership and permitted use of final deliverables created for a client—including logos, brand identities, website designs, written content and other creative assets—will be governed by the relevant proposal or service agreement.
Unless otherwise agreed in writing, drafts, unused concepts, working files, source files, proprietary methods and internal materials are not automatically included in a project handover.
Third-party fonts, plugins, stock assets, software, themes and other licensed materials remain subject to their respective licence terms.
We may display completed work in our portfolio or promotional materials only as permitted by the applicable agreement and subject to confidentiality obligations and any agreed restrictions.
7. Website Use and Content
You may access and use this website for lawful purposes.
You must not:
- Use the website in a way that violates applicable law.
- Attempt to gain unauthorised access to the website or its systems.
- Introduce malicious code or interfere with website operation.
- Copy, distribute or commercially exploit protected website content without permission.
- Misrepresent your identity or submit deliberately misleading information.
Website text, graphics, branding, layouts and other materials are owned by Unfold or used under appropriate permissions, unless otherwise stated. All rights not expressly granted are reserved.
8. Marketing and Performance Disclaimer
Marketing, advertising and growth services involve variables outside our control, including competition, audience behaviour, platform policies, budgets, pricing, product quality, sales processes and market conditions.
We do not guarantee specific results such as a particular number of leads, sales, rankings, conversions, revenue or return on advertising spend unless an expressly written agreement provides otherwise.
Recommendations and optimisation efforts are intended to support business objectives, but actual results may vary.
Advertising spend and third-party platform charges are separate from our service fees unless expressly included in the written agreement.
9. Business Support Disclaimer
Unfold may assist clients with navigating business registration, trademark applications, licence-related processes and other administrative requirements.
Unless expressly stated and legally authorised, these services are support and coordination services, not legal, tax, accounting or regulatory advice. We do not act as a government authority and cannot guarantee approval, registration, licensing or a particular processing time.
Government authorities, registries and other third parties make decisions according to their own rules and procedures. Clients may need to consult qualified professionals for specialist advice or representation.
The client remains responsible for the accuracy of submitted information, compliance with applicable requirements and payment of relevant government or professional fees.
10. Third-Party Platforms and Services
Our services may rely on third-party platforms, including website hosts, domain registrars, WordPress tools, Meta platforms, payment providers and other external services.
Those platforms are governed by their own terms, policies, availability and technical requirements. We are not responsible for interruptions, policy changes, account restrictions or failures caused by third-party providers, except to the extent applicable law or an agreed service contract provides otherwise.
We will communicate material dependencies relevant to the agreed scope where reasonably practicable.
11. Timelines, Suspension and Termination
Project timelines are based on the agreed scope, assumptions, dependencies and client responsibilities.
If a project is delayed, paused or terminated, the consequences—including payments due, treatment of completed work, handover of deliverables and any applicable cancellation charges—will be determined by the relevant proposal or service agreement and applicable law.
Either party may raise concerns about non-performance and seek a reasonable resolution in accordance with the applicable agreement.
Nothing in these terms removes rights or remedies that cannot legally be excluded.
12. Disclaimer of Website Information
We aim to keep website information accurate and useful. However, content may occasionally be incomplete, outdated or subject to change.
Website content is provided for general informational purposes and should not be treated as professional advice or a substitute for an individually agreed service.
To the extent permitted by applicable law, we do not warrant that the website will always be uninterrupted, error-free or free of harmful components.
13. Limitation of Liability
To the extent permitted by applicable law, Unfold will not be liable for indirect, incidental, special or consequential losses arising from the use of this website or from matters outside our agreed responsibilities.
Any liability arising from a paid engagement will be subject to the applicable proposal or service agreement and applicable law.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including any applicable non-excludable statutory rights.
14. Privacy
Our collection and handling of personal information are described in our Privacy Policy. By using our website, you should review that policy to understand our data practices.
15. Changes to These Terms
We may revise these Terms & Conditions from time to time. Updated terms will be published on this page with a revised “Last updated” date.
Changes will apply as permitted by applicable law. The terms applicable to an existing project will also be subject to its specific written agreement.
16. Governing Law and Disputes
These terms are governed by the laws of India, subject to applicable legal requirements.
The parties will endeavour to resolve disputes through good-faith discussions. Where a dispute cannot be resolved informally, it will be handled by the courts or other appropriate forum with jurisdiction under applicable law.
Any specific dispute-resolution or jurisdiction clause in a signed service agreement will apply to the extent legally enforceable.
